This End User License Agreement ("Agreement" or "EULA") is a binding legal contract between you ("End-User" or "you") and Libraprox ("Developer", "we", or "us"). It governs your download, installation, and use of the Libraprox application for iOS, macOS, or Android (the "Licensed Application"). Store-specific terms below apply to the version you obtained from each store.

By installing or using the Licensed Application, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not install or use the Licensed Application.

1. Acknowledgment of Parties

Developer and End-User acknowledge that this Agreement is between them only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Developer, not either app store, is responsible for the Licensed Application and its content, subject to applicable law and store terms.

2. Scope of License

For versions obtained through the Apple App Store or Mac App Store, the license granted to you is a non-transferable license to use the Licensed Application on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service, including applicable Family Sharing or volume-purchasing rules. For the version obtained through Google Play, you may use the Licensed Application on supported Android devices that you own or control, subject to this Agreement and the Google Play Terms of Service.

3. Maintenance and Support

Developer is responsible for providing any maintenance and support services for the Licensed Application as specified in this EULA or required by applicable law. Neither Apple nor Google is obligated to provide maintenance or support for the Licensed Application.

4. Warranty

Developer is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. For versions obtained through the Apple App Store or Mac App Store, if the Licensed Application fails to conform to an applicable warranty, you may notify Apple and Apple will refund its purchase price, if any; Apple has no further warranty obligation to the maximum extent permitted by law. For the Google Play version, any refund request is handled under Google Play's applicable policies. Other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are Developer's responsibility to the extent required by law.

5. Product Claims

Developer, not Apple or Google, is responsible for addressing claims by you or a third party relating to the Licensed Application or your possession or use of it, including:

• Product liability claims;
• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and
• Claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

If a third party claims that the Licensed Application or your possession or use of it infringes that party's intellectual property rights, Developer, not Apple or Google, is responsible for investigating, defending, settling, and discharging the claim.

7. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and
• You are not listed on any U.S. Government list of prohibited or restricted parties.

8. Acceptable Use and Restrictions

You agree to utilize the VPN connection tunnels established through the Licensed Application strictly for lawful purposes. You are explicitly prohibited from using the service to:

• Conduct hacking, port scanning, spamming, denial-of-service (DDoS) attacks, or server intrusion activities.
• Engage in illegal copyright infringement, software piracy, or unauthorized file distribution (e.g. torrenting copyrighted media on nodes where prohibited).
• Upload, transmit, or distribute illicit, abusive, defamatory, or unlawful materials.
• Attempt to bypass security features, exploit network vulnerabilities, or degrade server performance for other active users.

Violation of these acceptable use policies may result in the immediate and permanent suspension of your connection privileges.

9. Subscriptions and Transactions

Access to premium servers and ad-free usage requires an active Pro subscription. For subscriptions purchased in the app, billing, payment, renewals, and cancellations are handled by the Apple App Store, Mac App Store, or Google Play, depending on your platform, and are governed by that store's billing terms. Developer does not process those payments or cancel store subscriptions directly. For subscriptions purchased on the Libraprox website, RevenueCat Billing uses Stripe as its payment gateway, and the RevenueCat customer portal provides the available payment-method, invoice, cancellation, plan-change, and resubscription tools. Web subscriptions are associated with the Libraprox account used at checkout and may provide Pro access across supported platforms. Deleting your Libraprox account does not cancel a subscription; an active subscription must be cancelled with its billing provider and reach the end of its entitlement before account deletion can complete. Refund requests are subject to applicable law and the applicable billing provider's policies.

10. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, you must not violate your wireless network provider's data usage contract when routing traffic through the VPN).

11. Third-Party Beneficiary Status

This section applies to versions obtained through the Apple App Store or Mac App Store: Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you after you accept it. This Apple-specific provision does not make Apple a party to this Agreement.
